Cancellation of designs

Like utility models, designs are registered and acquire full validity upon registration. They do not undergo a substantive examination. Therefore, you will regularly come across designs that have no validity for lack of novelty or little difference compared to already existing designs. In view of the uncertainty involved, it may be wise to challenge such designs.  This also applies to cases where a competitor initiates proceedings against you for infringing a design whose validity is questionable.
